Terms of use

These terms of use define the rules for accessing and using the Nezam platform: the service covered, accounts and roles, everyone's obligations, availability, liability, termination and applicable law.

The Nezam platform (hereinafter "Nezam" or "the Service") is published by M. Fertah Mohammed, trading as Nezam®, whose details appear in the legal notice. By accessing or using Nezam, you (the "User") accept these terms of use (the "Terms") without reservation.

1. Purpose

The purpose of these Terms is to define the conditions under which the publisher makes the Nezam platform available and the ways in which the User may use the Service. Nezam is an educational management platform for community schools and language institutes. It brings together online enrolment, attendance, grades and report cards, student progress tracking, payments, two-factor authentication and a bilingual mobile app for parents and students, with data hosted in Europe.

Nezam consists of three surfaces sharing the same data: a web management workspace for the team (management and teachers), a bilingual French / Arabic mobile app for families (parents and students), and a public enrolment journey. These Terms apply to all of these surfaces.

2. Access to the service

Access to Nezam requires a subscription contract entered into between a teaching organisation (the "Customer") and the publisher. The Service is accessible through a web browser for the management workspace and through the mobile app for families. The User is solely responsible for setting up and operating their own equipment (hardware, software, internet access).

  1. The organisation takes out a subscription, billed per student per year; training, support, setup and maintenance are included.
  2. The publisher opens access and carries out the installation and rollout of the platform.
  3. The organisation creates accounts for its team and invites legal guardians and students according to the roles defined below.
  4. Each User accesses the surface matching their role, using their personal credentials.

Access to the web management workspace is reserved for teachers and management. Legal guardians and students use the mobile app and the public enrolment journey.

3. Payment & billing

Your Nezam subscription is billed per student per year, under the conditions agreed in the contract with the Client. Order and payment processing is carried out by our online reseller Paddle.com, which acts as the Merchant of Record for all our orders. Paddle therefore handles billing, payment-related customer service and refunds.

Paddle's Buyer Terms apply to every transaction. Applicable taxes (VAT or sales tax) are calculated and collected by Paddle based on the buyer's location, and prices are shown in your local currency at checkout. Accepted payment methods and the seller's identity are listed in the legal notice.

4. Accounts & roles

Using Nezam relies on named accounts associated with a role. Each role only grants access to the features that concern it.

Teacher Team web workspace Day-to-day teaching: attendance and roll call, grades, homework, learner records for the relevant groups.
Legal guardian (parent) Mobile app Read-only access (attendance, grades, report cards, homework) and messaging; enrolment via the public journey.
Student Mobile app Read-only access to their own school records and messaging.

Credentials are strictly personal and confidential. The User is responsible for keeping their credentials confidential and for any action carried out from their account. They undertake to report without delay any unauthorised use of their account to their organisation's administrator or to the publisher.

5. User obligations

The User undertakes to use Nezam in accordance with its intended purpose, these Terms and the applicable regulations. In particular, they may not:

  • use the Service for unlawful purposes or purposes contrary to public order;
  • attempt to access data or features that their role does not grant them access to;
  • disrupt, overload or compromise the security or integrity of the platform;
  • enter information that is inaccurate, misleading or that infringes the rights of third parties;
  • reproduce, copy or exploit the Service or its content beyond the authorised use.

The Customer is responsible for the accuracy and lawfulness of the data they enter (learners, legal guardians, grades, payments) as well as for collecting the necessary consents and authorisations from families. 6. Availability of the Service

The publisher uses reasonable means to ensure the availability and proper operation of Nezam, as well as its maintenance and updates, which are included in the subscription. As the Service is accessible online, access may be temporarily suspended for maintenance, updates, security reasons, or in the event of circumstances beyond the publisher's control (in particular force majeure or failure of third-party networks and hosting providers).

The publisher strives to keep the duration and frequency of interruptions to a minimum. No quantified availability rate is guaranteed by these Terms, unless a specific commitment is agreed in the contract entered into with the Customer.

7. Liability

Nezam is provided under a best-efforts obligation. The publisher cannot be held liable for damages resulting from non-compliant use of the Service, erroneous data entry by the User, a failure of the User's equipment or network, or an event of force majeure.

The User remains solely responsible for the pedagogical, administrative and financial decisions they make on the basis of the information displayed in Nezam. The calculations and automations (enrolment pricing, averages, payment statuses) are a management aid and do not exempt the User from their own checks.

8. Termination

The Nezam subscription has no fixed-term commitment and comes with a money-back guarantee. The Customer may stop using the Service under the conditions set out in the contract entered into with the publisher.

The publisher reserves the right to suspend or terminate a User's access in the event of a serious breach of these Terms, in particular in the event of fraudulent use, an attempt to compromise the platform's security or a failure to respect the rights of third parties. At the end of the contractual relationship, the terms for returning and deleting data are described in the GDPR & data protection page.

9. Intellectual property

Nezam® is a registered trademark. The platform, its name, logo, visual identity and all of its software components are protected. No reproduction, representation or exploitation, in whole or in part, may be carried out without the publisher's authorisation. The data entered by the Customer remains the property of the Customer.

10. Changes to the Terms

The publisher may update these Terms to reflect changes to the Service or to the regulations. The applicable version is the one in force and published on this page on the date of use, the last update of which is indicated at the top of the document.

11. Applicable law & jurisdiction

These Terms are governed by the terms of the contract entered into with Nezam. In the event of a dispute relating to their interpretation or their performance, the parties will endeavour to find an amicable solution. Failing agreement, the dispute will be brought before the competent courts.
